How do you resolve a boundary dispute with your neighbor?

On Behalf of | Nov 29, 2022 | Commercial Real Estate

Boundary disputes are common among neighbors. Sometimes, they are just minor disagreements that are easily solved, while in others, they may evolve into something bigger than a misunderstanding. Either way, a dispute with your neighbor over boundary lines can be quite stressful.

You may find it hard to get a buyer for a property with lingering issues like boundary disputes, and even if you do, you are likely to get a low offer. Therefore, it is crucial to resolve such a dispute as soon as possible to avoid such problems. Here is what you need to do.

Get to the bottom of the dispute

Boundary disputes can arise for a variety of reasons. They include:

  • Changes in ownership
  • Adverse possession claims
  • Building improvements
  • Inaccurate or inconsistent surveys
  • Right of way, among others

Understanding the cause of the disagreement with your neighbor is crucial as it will help you work towards a viable solution, unlike when you are unaware of the issues at the heart of your boundary dispute.

Carefully weigh your options

Remember, the goal is to resolve the boundary dispute in the most efficient way possible. Engaging in constructive dialogue with your neighbor is an excellent place to start.

Talk to them and get their opinions on the situation. It may be possible to arrive at an amicable solution this way which could save you a great deal of time and money. You can also rope in a third party to act as a mediator and help find a middle ground that works for both of you.

If this does not work out and a lasting solution is not in the offing, you may have to take the matter to court. It is usually a measure of last resort, but you should anticipate it and be well prepared should things get here.
